Terms & Conditions

Thank you for choosing The MK Clinic. We are committed to providing high-quality services and care. The terms outlined below explain how we operate and what you can expect from us. Please take the time to read them carefully before undergoing any treatment. If you have any questions or concerns, feel free to contact us.

1. Our Terms

1.1 These terms and conditions set out the basis on which The MK Clinic provides services to you.

1.2 Please read them thoroughly before booking your appointment. They contain important information about our services, your rights, and our responsibilities.

2. About Us and How to Contact Us

2.1 We are The MK Clinic, operating from 4 Lee Street, Dewsbury, WF13 3DH.

2.2 You can contact us by phone at 07544 073347 or by email at themkclinic@outlook.com.

2.3 We may contact you via telephone, email, text message, or by post using the details you provide at the time of booking.

2.4 When we refer to “writing” in these terms, this includes emails and text messages.

3. Our Contract With You

3.1 A contract between you and The MK Clinic is formed when you request a treatment and we confirm your appointment by providing details of the initial consultation (date and time). This may be done verbally (in person or by phone) or in writing.

3.2 You may be required to pay a deposit when booking your consultation or treatment. The deposit amount will vary depending on the treatment and will be confirmed at the time of booking.

3.3 If you miss your initial consultation without providing at least 48 hours’ notice (see clause 7.2(a)), it is at our discretion whether another appointment will be offered. In such cases, a full payment may be required to secure a new appointment.

4. Providing the Services

4.1 We will deliver the agreed services to you during your Initial Consultation and throughout any necessary follow-up sessions or as part of a scheduled series of treatments (referred to as a "Course"), starting from your Initial Consultation and continuing until the agreed services are completed.

Details of all our treatments and Courses are available via our clinic information materials and social media channels.

4.2 All practitioners at The MK Clinic are fully trained and operate in line with our established clinical protocols.

4.3 It is your responsibility to ensure we have accurate and complete health-related information prior to each session. We may request additional information depending on the type of treatment being provided. If you do not supply the requested information within a reasonable time frame, or if the information provided is incomplete or inaccurate, we reserve the right to:

  •   End the agreement (see clause 8.2(c)); or
  •   Charge a reasonable fee to cover any additional time or resources required as a result.

We are not liable for delays or interruptions in providing services if caused by a lack of the necessary information from you.

4.4 Unsuitability for Treatment

If we determine that:

(a) You are medically unfit for treatment (see clause 8.1); and/or

(b) You are not a suitable candidate for your requested treatment; and/or

(c) The treatment is unlikely to be effective for your condition,

We will explain our findings clearly and provide the reasons behind this decision. In such cases, if these findings are made during your Initial Consultation, you will only be charged for that consultation and no further treatment will be provided.

4.5 While we strive to provide all services with the utmost care and professionalism, it is important to understand that no clinical procedure is without risk, and outcomes can vary between individuals. Details of potential risks and common side effects are available on our social media pages and are linked in your booking confirmation message.

5. Attendance at The Clinic and Pre-Treatment Preparation

5.1 We kindly ask that you arrive at The MK Clinic at least 5 minutes before your scheduled appointment. Arriving late may result in your treatment time being shortened. If you anticipate being late, please call us on 07544 073347 and we will do our best to accommodate you. However, please note that priority will be given to clients who arrive on time, and we cannot guarantee that your full session will still be provided.

5.2 If your treatment requires specific preparation, we will inform you in advance. Failure to follow these instructions may lead to delays, shortened treatment time, or additional charges. Repeated failure to comply may result in termination of your treatment plan and cancellation of any future appointments, without further notice.

5.3 For safety and privacy, non-patients are not permitted in the treatment room. Any guests accompanying you must remain in the designated waiting area.

5.4 Appointments for children or young adults under the age of 16 can only be booked with prior arrangement. We assess each case individually, in line with our insurance policies, to ensure the treatment is appropriate and safe for the individual.

6. Rights to Suspend or Make Changes

6.1 If you need to make a change to your scheduled treatment or the date/time of your Initial Consultation, please contact us as soon as possible. We'll let you know whether the change is possible and inform you of any impact this may have on the price, timing, or any other details of your service. We'll ask you to confirm if you'd like to proceed with the updated arrangements

6.2 Our Rights to Suspend or Modify Services:

(a) We may need to suspend or adjust our services:

(i) Due to circumstances outside of our control; and or

(ii) To comply with changes in legal or regulatory requirements; and or

(iii) To make minor technical updates or
improvements to our services.

(b) In some cases, we may need to suspend services long-term or permanently, or make more substantial changes (e.g. updates to pricing).

In all instances (listed above), we will do our best to contact you in advance. If these changes affect you, you have the option to cancel your contract with us and request a full refund for any pre-paid treatments that have not been provided as of the suspension date.

(c) If payment for services is not received when due (see clause 10.4), we reserve the right to suspend your treatment until the outstanding balance is settled.

7. Your Right to End the Contract

7.1 You have the right to cancel your agreement with The MK Clinic at any time before the services have been delivered and paid for. However, depending on the timing and reason for cancellation, we may charge you a fee, as outlined below.

7.2 If you are cancelling the contract for one of the reasons listed below in sections 7.2 (a) to (f), the contract will end immediately and you will receive a full refund for any services that have not yet been provided or were not provided properly. Valid reasons include:

(a) You notify us by phone or in writing at least 24 hours before your Initial Consultation or follow-up appointment that you wish to reschedule;

(b) We have informed you of a significant change to the services or these terms, and you do not accept the change (see clause 6.2(b));

(c) We have made an error in the price or description of the services and you choose not to go ahead;

(d) The services are likely to be significantly delayed due to circumstances beyond our control;

(e) We suspend the services for technical reasons, or inform you that services will be suspended for more than 14 days;

(f) You are legally entitled to cancel the agreement due to a fault on our part.

7.3 If You Cancel Without a Valid Reason

If you choose to end the contract for reasons not listed in clause 7.2, the agreement will still be terminated immediately; however, any deposit paid under clause 3.2 will be retained by The MK Clinic as reasonable compensation for costs incurred due to your cancellation.

In addition:

(a) If less than 24 hours' notice is given (as outlined in clause 7.2(a)) or if you fail to attend any scheduled appointment, a £25 cancellation fee will apply. Future bookings or continued treatment will be entirely at our discretion and may require an additional deposit, the amount of which will also be determined at our discretion.

(b) If your treatment plan involves a Course of sessions, and you cancel any individual appointment in the Course with less than 24 hours' notice, full payment for the missed session will be required before any further appointments can be scheduled or attended.

8. Our Right to End the Contract

8.1 The MK Clinic reserves the right to terminate your treatment at any time if we determine that you are medically unfit to proceed with the requested treatment, or if you have not followed the advice and guidance provided as part of your recommended care plan.

8.2 We may also end the contract if you breach its terms. We are entitled to terminate the agreement immediately by written notice if:

(a) You fail to make a required payment on time;

(b) You repeatedly miss scheduled appointments; or

(c) You do not provide us with the necessary information we have requested (as described in clause 4.3), which is required for us to safely and effectively deliver your treatment.

8.3 If the contract is ended due to your breach (as described in clause 8.2), we will refund any advance payments made for treatments not yet delivered. However, we will retain your deposit (paid under clause 3.2) as reasonable compensation for the costs incurred due to your breach of the agreement.

9. If There Is a Problem with the Services

9.1 If you have any questions, concerns, or complaints about the services you have received, please don’t hesitate to get in touch with us. You can contact The MK Clinic by phone at 07544 073347 or by email at themkclinic@outlook.com. We are committed to resolving any issues promptly and professionally.

Please note that additional fees may apply for services that fall outside of the standard treatment pathway. These may include extra follow-up appointments or specialist procedures. You will always be informed of any additional costs before they are incurred.

By booking your Initial Consultation, you confirm your understanding and acceptance of the treatment costs and your commitment to pay.

10.2 When and How to Pay

  • If the total cost of your treatment exceeds £500, full payment must be made in advance of treatment.
  • If the cost is less than £500, payment is required on the day of your Initial Consultation.

We accept payment via most major debit and credit cards, cash, and Bankers Drafts.

Please note that we do not accept American Express cards or cheques from banks, building societies, or other institutions.

11. Our Responsibility for Loss or Damage Suffered by You

11.1 If The MK Clinic fails to meet these terms, we accept responsibility for any loss or damage you suffer that is a foreseeable result of our breach of contract or failure to exercise reasonable care and skill. Loss or damage is considered foreseeable if it is either obvious that it would happen, or if it was discussed and understood by both parties at the time the agreement was made.

However, we are not responsible for any loss or damage that is not foreseeable, or for any economic, special, indirect, or consequential loss resulting from our services — including any damage that occurs due to your failure to provide essential information as outlined in clause 4.3.

11.2 We do not exclude or limit our liability where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence (or that of our staff), for fraud or fraudulent misrepresentation, or for any breach of your legal rights in relation to the services (including your right to receive services that are accurately described and delivered with reasonable care and skill).

11.3 We are not liable for any business-related losses. Our services are provided strictly for private and personal use, and we will not be held responsible for loss of business profits, loss of business opportunities, or any form of business interruption.

12. How We May Use Your Personal Information

12.1 We will use the personal information you provide to The MK Clinic for the following purposes:

(a) To deliver the services you have requested;

(b) To process your payments;

The MK Clinic operates a strict no-smoking policy. Smoking is not permitted anywhere on the premises.

Cancellation Fee Terms and Conditions – The MK Clinic

  1. All clients of The MK Clinic are required to agree to our Appointment Cancellation Charges Policy before booking. We reserve the right to withhold treatment where this agreement is not confirmed.
  2. Appointment Cancellations and Charges - If you cancel or request to reschedule your appointment with less than 24 hours' notice, or if you do not attend your scheduled appointment, a cancellation fee will apply. Where a deposit has been paid, it will be retained as the cancellation charge. If no deposit has been paid, the full session fee will be due before any further appointments can be scheduled.
  3. Cancellation fees apply to all appointments, regardless of the treatment type or cost.
  4. Failure to receive an appointment reminder (via text or email) is not considered valid grounds for missing an appointment.
  5. If a client wishes to cancel a course of treatments and avoid a cancellation charge, the treatments already received will be recalculated at the ‘single-session’ rate. Any remaining balance will be refunded accordingly.
  6. In the case of cancellation or non-attendance due to exceptional circumstances, the relevant cancellation charge will still apply and must be paid before a new appointment can be scheduled. Refund decisions will be made at our discretion on a case-by-case basis.
  7. In certain situations, we may request full upfront payment for an appointment. If that appointment is later cancelled or missed, the payment will not be refunded.
  8. Reassessment appointments or those scheduled to address genuine concerns around the treatment may be offered free of charge. We reserve the right to charge for time spent, where appropriate, with this being communicated in advance.
  9. Clients will be advised of their appointment time and date upon booking. Please aim to arrive at least five minutes early to complete any pre-assessment requirements. Late arrivals may result in reduced treatment time.
  10. If you are running late, please contact the clinic as soon as possible. We will do our best to accommodate changes, but please be aware that lateness may cause further delays or shortened appointments due to the clinic’s schedule, and priority will have to be given to on-time appointments.
  11. The MK Clinic will make every effort to keep appointments on time. However, delays may occur due to unforeseen circumstances. In rare instances, we may need to cancel or reschedule your appointment at short notice. We will contact you promptly and rebook your session at a mutually convenient time. We do not offer compensation in these circumstances.
  12. Before your appointment, we may provide specific instructions or preparations for treatment. Failure to follow these may lead to delayed treatment, shorter session times, or additional charges.
  13. All treatments are subject to an initial assessment for medical suitability. If we determine you are not suitable for a requested treatment, or if we believe it will not be effective, we will explain our reasoning. In such cases, only the initial consultation fee will be charged, if applicable.
  14. Clients are responsible for providing accurate and complete medical information before each treatment. We are not liable for issues arising from withheld or inaccurate information.
  15. The MK Clinic is not responsible for any economic losses (including loss of profit), or other indirect, special, or consequential damages arising from the provision of services.
  16. Unless you have pre-purchased a course of treatments, the outstanding balance for each session must be settled in full on the day of your appointment. For any appointment exceeding £500, full payment is required in advance. We may request confirmation of your ability to pay prior to providing treatment.
  17. If you have purchased a course of treatments but are unable to complete them, you may be eligible for a partial refund. The refund will be calculated by deducting the full list price of the treatments already received from the total paid.
  18. All courses or multi-session treatments must be completed within 12 months of the initial consultation or purchase date. After 12 months, any remaining sessions will be forfeited.
  19. We accept payment via most major debit/credit cards and cash. We cannot accept American Express or personal cheques.
  20. Non-payments may be referred to debt recovery services.
